A message from Diana Kern, Legacy Land Conservancy Executive Director
This summer, you may remember that the federal government rescinded our $24.6 million Regional Conservation Partnership Program (RCPP) award–funds that would have helped Legacy and our partners protect more than 4,000 acres of farmland and forest in southeast Michigan.
We promised you then that we would not give up. And we haven’t.
On Sept. 22, several Legacy staff and one of our attorneys participated in a five-hour formal appeal hearing before the USDA National Appeals Division. It was a long day of presenting evidence, answering questions, and making the case for why this critical conservation project funding was incorrectly rescinded and must be reinstated.
What happens next:
➡Over the next 30 days, we can submit additional documents and evidence.
➡After that, we’ll have another 30 days to submit closing arguments.
➡The judge will then have 30 days to issue a decision—likely by late December.
➡With the federal government shut down though, this work is paused and could see significant delays.
While the process is long and exhausting, Legacy remains strong, focused, and hopeful. We are standing by our commitment to the Michigan farmers, families, and landowners who were counting on this support, and we are determined to see it through.
Most importantly—we couldn’t do this without you. Your encouragement and trust fuel our persistence, no matter the obstacles. Together, we are ensuring Michigan’s farmland and forests have the protection they need today and for generations to come.
Thank you for standing with us. We’ll keep you updated as soon as there’s news to share.
With gratitude,
Diana Kern
Executive Director
P.S. – Many of you have asked how you can help as Legacy navigates this unexpected challenge. The truth is, the appeal has brought unplanned expenses. The most impactful way to stand with us right now is through a gift. This fall, every dollar will be matched—up to $100,000—thanks to the Ardent Spirits Fund and the McMullen Family. Donate today and double your impact!
